Town Sets Date for Annexations

The Prosper Town Council voted at last week's meeting to approve the schedule for the Involuntary annexations in Denton County.

According to Town Manager Mike Land, "in 2009 the Town Council completed annexing and or entering into agreements with land owners whose properties were still in the county even though they were surrounded by the Town of Prosper's town limits.

"This process will complete the annexation process for properties in the Town's Extraterritorial Jurisdiction which like the Collin County properties are adjacent to and or already surrounded by existing Town limits," Land said.

The process should be complete this summer.

In other business:

The council approved a Professional Landscape Architecture Services Agreement with Studio 13 Design Group, PLLC., regarding Landscape Design of Prosper Trail. Land said the cost of the contract was $11,875. The contract will be for landscape design for the Prosper Trail right-of-way between Preston and the Dallas North Tollway.

The council approved a right-of-way services agreement with Halff Associates, Inc. for the Dallas North Tollway, Phase 4A. Land said, "there are a few remaining parcels along the DNT needed for the eventual construction of the remaining service road and main lanes. Halff will be preparing the legal descriptions of these remaining parcels."

The council approved a change order to RLK Engineering, Inc, for the First Street Improvements (Preston Road to Coit Road) and Coit Road Improvements

(First Street to US 380). RLK is already under contract for the design of Coit and First St. As a result of the engineering design being completed, specifically the design of the storm water drainage element, additional parcels are needed to accommodate the project. This amendment to the contract allows for the legal descriptions to be completed and RLK to work on acquiring the needed parcels.

The council directed staff to submit a written notice of appeal on behalf

of the Town Council to the Development Services Department, pursuant to Chapter 4, Section 1.5(C)(7) and 1.6(B)(7) of the Town's Zoning Ordinance, regarding action taken by the Planning & Zoning Commission on any site plan or preliminary site plan.

Land said it is a "typical process for the Council to question any site plan approval by the Planning and Zoning Commission when they approve a site plan. In this case the site plan approved is for the outparcels along Hwy 380 west of Custer Rd. in the shopping area called Prosper Plaza, where the Kohl's is planned to be constructed."

The council adopted the 2010 Town Council Workplan. The workplan for 2010 includes goals for staff and Council covering financial management and benchmarking, citizen involvement, updating codes, investing in capital infrastructure, and enhancing public safety. The workplan continues efforts centered around the Town Council's goals for 2015.

The council heard a presentation of the audit for fiscal year 2008-2009 given by Tom Pingleton of Pingleton, Howard & Company, P.C., Certified Public Accountants.

The council acted on a request from the Prosper Developers Council to classify the Prosper in Prosper Campaign as a special event per Section 1.18 of the

Sign Ordinance and to allow seven signs associated with

the special event to be erected for a maximum of 180 days.

This means the "mini" billboards promoting homes in Prosper along Hwy 380 and Preston Rd. will remain up for another 180 days.

The council provided direction on investigating the creation of a green building code for multi-family development in Prosper.

There is already a green building code for single family homes, going into effect late this year. "This discussion centers on multi-family projects and Council did instruct staff to only investigate what codes are in the marketplace to support green/energy efficient construction in multi-family projects," Land said.
